Terms of Use

1. About these terms

These terms of use (“Terms”) apply to the mobile apps published by Thomas Cole, trading as TheBigEDev (thebigedev.co.uk), a sole trader based in the United Kingdom (“we”, “us”, “our”) – currently the Sports Tips Star app – and to the website www.starsportstips.com. The app and its paid options are described in the schedule at the end. By downloading or using an app, you agree to these Terms. If you don’t agree, please don’t use the app.

2. Who can use the apps

• You must be 18 or over, or older if the law where you live sets a higher minimum age for gambling or betting-related services (for example 21 in some US states).
• You must only use the apps where it’s legal to access sports-betting information. You’re responsible for following the laws where you live.

3. Apps downloaded from the Apple App Store

If you got an app from the Apple App Store, Apple’s Standard Licensed Application End User License Agreement (the “Standard EULA”) applies to your use of it, and these Terms apply alongside it. If they conflict about the licence to use the app, the Standard EULA wins. You also acknowledge that:

• these Terms are between you and us, not Apple. We, not Apple, are responsible for the app and its content;
• Apple has no obligation to provide maintenance or support for the app;
• if the app fails to meet any applicable warranty, you can tell Apple, and Apple may refund the purchase price (if any) for the app. To the extent the law allows, Apple has no other warranty obligation for the app;
• we, not Apple, are responsible for handling any claims relating to the app, including product liability claims, claims that it doesn’t meet legal or regulatory requirements, and consumer-protection or privacy claims;
• if a third party claims that the app infringes their intellectual property rights, we, not Apple, are responsible for dealing with that claim;
• you confirm that you’re not in a country subject to a US Government embargo or designated as “terrorist supporting”, and that you’re not on any US Government list of prohibited or restricted parties;
• you must follow any third-party terms that apply when you use the app (for example, your mobile network’s terms);
• Apple and its subsidiaries are third-party beneficiaries of these Terms and can enforce them against you.

If you got an app from Google Play, Google Play’s terms of service also apply to your download and purchases.

4. What our tips are, and what they aren’t

• The app and the website provide tips, predictions, star ratings, statistics and hit rates for information and entertainment only. They are opinions. They are not betting, financial or other professional advice, and they are not a recommendation to place any bet.
• We don’t guarantee any outcome, result, profit or level of accuracy. Sport is unpredictable, tips can and do lose, and past results (including any hit rates we publish) don’t predict future results.
• TheBigEDev is not a bookmaker and doesn’t take bets. We don’t hold your money, run betting accounts or receive any payment linked to bets you place.
• We are not responsible for, and will not refund or compensate, any bet placed or any loss incurred by anyone, including when a tip loses, when information is wrong or late, or when the app or website isn’t available. This applies to free and Premium tips alike: a subscription buys access to content, not any result. It doesn’t affect your rights about the subscription itself (sections 7 and 11).
• Some content (for example fixtures, scores, kick-off times and some horse-racing selections) comes from third parties and may be wrong, delayed or changed. Always check the details with your bookmaker before placing a bet.
• Any decision to bet is yours alone, and so is the responsibility for it.

5. Gamble responsibly

Only bet what you can afford to lose, set yourself limits, and never chase losses. If gambling stops being fun, or is affecting you or someone close to you, free and confidential help is available:

6. Free features, ads and rewarded unlocks

The free version of the app shows ads. You can watch a rewarded video ad to unlock Premium tips for a short time. The schedule shows how long it lasts and how many times you can do it. Rewarded unlocks have no cash value and can’t be transferred.

7. Subscriptions

Sports Tips Star offers auto-renewing Premium subscriptions. The schedule at the end lists the plans and what they include.

• Price: the price of each plan is shown in the App Store (or Google Play) before you confirm your purchase, in your local currency, including any applicable taxes. Prices can vary by country.
• Payment: payment is charged to your Apple ID account when you confirm the purchase (or to your Google account for Google Play purchases).
• Automatic renewal: your subscription renews automatically for the same period unless auto-renew is turned off at least 24 hours before the end of the current period. Your account will be charged for the renewal within 24 hours before the end of the current period, at the price of your plan.
• Managing and cancelling: you can manage your subscription and turn off auto-renewal at any time after purchase in your Apple ID account settings (on iPhone: Settings > [your name] > Subscriptions; see Apple’s guide to cancelling a subscription). For Google Play, use Play Store > Payments & subscriptions > Subscriptions. Deleting the app doesn’t cancel a subscription. If you cancel, you keep access until the end of the period you’ve paid for.
• Free trials: if we offer a free trial, any unused part of it ends when you buy a subscription.
• Price changes: if the price of your subscription changes, Apple or Google will tell you in advance and, where required, ask for your agreement before the new price applies.
• Refunds: purchases are processed by Apple (or Google), so refunds are handled by Apple under Apple’s refund policies. You can ask for one at reportaproblem.apple.com (see Apple’s guide to requesting a refund). For Google Play purchases, follow Google Play’s refund process. We can’t issue refunds for store purchases ourselves, but we’re happy to help if you contact us. Nothing in these Terms affects your statutory rights.
• Restoring purchases: if you change or reset your device, use “Restore” in the app while signed in with the same Apple ID or Google account.

8. Acceptable use

You may use the apps for your own personal, non-commercial use. You must not:

• copy, sell, resell, publish or share our tips or content (for example in paid tipster groups, social media channels or other apps or websites) without our written permission;
• scrape, harvest or download content automatically, or access our servers (including api.starsportstips.com) other than through the apps;
• get around paywalls, ad-unlock limits or other technical restrictions, or reverse-engineer the apps, except where the law allows you to;
• interfere with, overload or try to break the security of the apps, our servers or our providers;
• use the apps illegally, or in a way that harms other people.

We may suspend or end your access if you break these rules.

9. Intellectual property

The apps, our tips and our content, design and logos belong to us or our licensors. We give you a personal, non-transferable licence to use the apps under these Terms (and, for App Store apps, the Standard EULA). Team names, club badges, competition names and other trade marks belong to their owners. We use them only to identify fixtures, and their use doesn’t imply any endorsement or connection.

10. Changes and availability

We keep improving the apps, so features, sports, leagues and markets may change. We try to keep the apps available, but we can’t promise they’ll always be available or error-free, or that tips will be published at a particular time. If we remove a paid feature you’ve paid for, or stop providing an app, you may have rights under consumer law. Contact us, or ask Apple or Google for a refund.

11. Our liability

• Nothing in these Terms limits or excludes our liability for: death or personal injury caused by our negligence; fraud or fraudulent misrepresentation; or anything else that can’t be limited or excluded under the law of the United Kingdom. Nothing in these Terms affects your statutory rights as a consumer. For example, in the UK, digital content must be as described, fit for purpose and of satisfactory quality.
• Because our tips are information and entertainment, not guarantees (section 4), we aren’t responsible for any bet, any betting loss, or any decision you make based on our content.
• We aren’t responsible for losses that weren’t reasonably foreseeable, or for business losses (the app and website are for personal use only).
• Subject to the first point above, our total liability to you for all claims relating to the app or the website is limited to the greater of (a) the total amount you paid us for the app and its subscriptions in the 12 months before the event giving rise to the claim, and (b) £50.

12. Other services

The apps use services from other companies, such as Apple, Google and RevenueCat, and may link to other websites. Those companies’ own terms and privacy policies apply to their services. We aren’t responsible for third-party websites.

13. Your privacy

Our Privacy Policy explains how we use personal data, including for ads, analytics, notifications and subscriptions.

14. Ending these Terms, changes, and the law that applies

• You can stop using an app at any time by deleting it. Remember to cancel any subscription separately (section 7).
• We may update these Terms, for example when we add a new feature. We’ll change the “Last updated” date and, for important changes, tell you in the app or on this page. If you keep using the app after a change, the new Terms apply. Changes won’t affect a subscription period you’ve already paid for.
• If any part of these Terms is found to be unenforceable, the rest still applies.
• Governing law and courts: these Terms are governed by the laws of England and Wales, and the courts of England and Wales have jurisdiction. If you’re a consumer living in Scotland or Northern Ireland, you can also bring proceedings in your local courts (the Scottish or Northern Irish courts). If you’re a consumer living elsewhere, you keep any protections that the law where you live says can’t be overridden by contract.
